Southerland, Chief Justice:

The suit concerns the enforceability of certain provisions of a separation agreement entered into by the parties when they were man and wife.

The facts are these:

The parties were married in 1938. Three children were born of the marriage. Their married life became unhappy, and in October 1954 they separated. A formal agreement of separation was entered into in November, 1954. Each party was represented by counsel.
