Petitioner, a native of Tunis, Africa, was ordered deported after a hearing pursuant to § 242 (b) of the Immigration and Nationality Act of 1952, 66 Stat. 209, 8 U. S. C. § 1252 (b). It was found that he had been convicted in 1938 of violation of the Marihuana Tax Act, 26 U. S. C. § 2591, and sentenced to imprisonment for one year. Section 241 (a) (11) of the 1952 immigration law1 makes such conviction at any time ground for deportation, and § 241 (d) 2 provides that the deportation provisions of § 241 (a) shall apply even though the facts giving rise to the alien’s deportability occurred…
