Jamison and Alvin Engle were jointly indicted at the September term, 1906, of the district court of the Second judicial district of the territory of Oklahoma, within and for Roger Mills county, in said territory, for the crime of grand larceny.

(after stating the facts as above). 'The first three assignments of error present a question as to the regularity of the transfer of the case, as made, from the district court of Roger Mills county to the district court of Beckham county.
