The plaintiffs in error, Willard P. Mitchell and Scott Mitchell, were convicted of the larceny of three mules, the property of William Wyanco, and on February 20, 1897, sentenced to five years each in the territorial penitentiary at Lansing, Kan. O'n the trial of the cause, the prosecution proved that William Wyanco was the owner of three mules, of the value of $180, and that they were taken from his premises in the latter part of February, 1892, without his knowledge or permission, and that about three days afterwards the defendants were arrested in the…
