This matter is before the Court for decision following a bench trial. This is the fifth opinion that this Court has published in this case.
Plaintiffs Edward McAleer, administrator of the estate of James F. McAleer, and Hardy and Joan LeBel, administrators of the estate of Thomas LeBel, brought this action against the American Sail Training Association (“ASTA”) and others for the alleged wrongful deaths of their decedents, James F.
