This suit was begun by appellee, Henry McCarthy, filing a bill for the partition of certain lands of John Earl, deceased. The bill alleged that Earl was the owner of certain lands therein described; that he died November 13, 1905, leaving no children nor descendants of a child or children, no widow and no father nor mother surviving him; that he left surviving him Lydia Cheshire, a sister; Edgar D.
