AINSWORTH, Circuit Judge:
In this Texas diversity action, Allen W. Bliss brought suit against The Equitable Life Assurance Society of the United States (Equitable) and Encyclopaedia Britannica, Inc. (Britannica), to recover benefits allegedly owing on three group insurance contracts covering his deceased wife Mary Frances Bliss (Mrs. Bliss). He also sought exemplary damages for Equitable’s and Britannica’s allegedly malicious refusal to pay benefits. The case was submitted to the jury on the basis of certain special issues.
