In an action, inter alia, to recover damages for breach of contract *904and. fraud, defendants appeal from an order of the Supreme Court, Westchester County (Beisheim, J.), entered December 2, 1983, which granted plaintiff’s motion for a default judgment and calendared an inquest on the issue of damages.

Order affirmed, with costs.

The record indicates that all five of the defendants were-personally served with a summons and complaint on July 29, 1983 and were in default even prior to August 31, 1983, when they retained counsel and when an answer on behalf of all five defendants was served upon,…
