Williams, Judge:
H. P. Locke was awarded this writ of error to a judgment recovered against him by the City of St. Marys for the sum of $148.45, in an action, originally brought before a justice of the peace to recover 'a special assessment levied upon his property for the laying of a sidewalk on a street adjacent thereto, and appealed to the circuit court. Locke’s counsel insists that the *32justice was without jurisdiction. If the justice had not jurisdiction, it follows that the circuit court acquired none by appeal.
