Defendant was tried on the charge of unlawfully selling intoxicating liquor for beverage purposes, and was convicted on the charge. Immediately after the trial he filed a motion in arrest of judgment, based upon the ground that the trial was begun and closed, and the judgment of conviction rendered and entered on June 3, 1925, which is a legal holiday in this state, set aside by law as Confederate Memorial Day.
