Defendant James A. Kulpa was charged with attempt murder (Ill. Rev. Stat., 1978 Supp., ch. 38, par. 8 — 4), armed violence (Ill. Rev. Stat., 1978 Supp., ch. 38, par. 33A — 2,12—4(a)), and three counts of aggravated battery (Ill. Rev. Stat. 1977, ch. 38, par. 12 — 4). After a jury trial defendant was found not guilty of attempt murder, not guilty of armed violence, and guilty of aggravated battery.
