— The plaintiffs brought suit in the district •court for Cassia county to restrain defendant from using the waters of Eaft river from the first day of October tp the first day of April. Upon the filing of plaintiffs’ complaint, an order to show cause at the town of Hailey, in Blaine county, Idaho, on the fifth day of December, 1895, why an injunction should not issue as prayed, was issued, and duly served upon the defendant.
