Plaintiff Erwin J. (“Jack”) Spence, Jr., appeals from a judgment entered in the United States District Court for the Western District of New York, William M. Skretny, Judge, dismissing his complaint against defendants Maryland Casualty Co. (“Maryland Casualty” or the “Company”) et al., seeking monetary relief principally for an alleged constructive discharge in violation of the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. §§ 621-634 (1988), and state law.
