The within contested matter is before the Court by way of a motion filed by Trustee Randy J. Schaal (“Trustee”) objecting to Leslie and Charlene Moore’s (“Debtors”) claimed exemption for a certain annuity contract (“annuity”). The Trustee’s motion, filed pursuant to Federal Rule of Bankruptcy Procedure 4003(b), asserts that the annuity was purchased with the intent to hinder, delay, or defraud creditors and therefore the claimed exemption is avoidable pursuant to New York Insurance Law (“NYIL”) §…
