This matter comes before the Court on the motion of Robert J. Musso (the “Trustee”), the chapter 7 trustee in this case, to disallow the claimed homestead exemption of Ulysses T. Moulterie (the “Debtor”) in property located at 81 Malcolm X Boulevard, Brooklyn, New York (the “Property”). Although he advances several arguments in support of his position, the Trustee’s principal contention is that the Debtor’s homestead exemption should be disallowed because the Debtor was not living at the Property when this bankruptcy case was commenced.
