BREWSTER, District Judge.

-I have for consideration defendant’s motion to reeommitan auditor’s report, with directions to revise-in respect to certain rulings of law and findings of fact. The action is one in contract,, brought by a seller to recover the purchase price for goods sold and delivered. Both parties seem to agree that the Uniform Sales Act (G. L. Mass. c. 106) applies to the transactions in controversy. The report discloses a state of facts which may be summarized as-follows:
