This suit was instituted in the district court of Lubbock county by Morton J. Smith, J. H. Moore, and Prank Vaughn,* plaintiffs, against Rochester Haddaway, defendant.
Prank Vaughn died before the trial of the case, and his heirs were .substituted as parties to the suit, and will, for the purpose of this opinion, be considered as original plaintiffs.
Plaintiffs allege that in 1920 defendant owned and listed with them, as real estate brokers, several tracts of land situated in Bailey county, Tex., and agreed to pay them TYz per cent, commission for the sales made by them, or for the procuring of…
