Norman C. Doughty and David T. Doughty each appeal a judgment denying his petition for review after the director of revenue revoked his driving privileges for one year for refusing to take a breathalyzer test. The Doughtys claim section 302.3121 violates the 14th Amendment to the United States Constitution and article I, section 10 of the Missouri Constitution because it permits department of revenue records to be admitted in evidence in violation of the Doughtys’ due process rights to confront and cross-examine the witnesses against them.
