Appeal from a judgment of the superior court for Pierce county, Clifford, J., entered December 91, 1911, upon the verdict of a jury rendered in favor of the plaintiff, in an action for personal injuries sustained at a railroad crossing.

This is an action to recover damages for personal injuries which the plaintiff alleges resulted to him from the negligence of the defendant railway company, and Hayes, its locomotive engineer, in the operation of one of its trains in approaching the crossing of Spinning street, in the city of Puyallup. The defendants denied the negligence charged against them, and also alleged that the plaintiff’s injuries resulted from his own carelessness and contributory negligence. A trial before the court and a jury resulted in a verdict and judgment in favor of the plaintiff, from which the defendants…
