The plaintiffs, Geoffrey M. Smyth, Burton J. Power, and Christopher C. Yule, brought a four-count complaint against Marshall Field, Fifth, CC&F Investors, Inc. (CC&F Investors), CC&F Commercial, Inc. (CC&F Commercial)(hereinafter collectively the CC&F defendants), MGH Health Services Corporation (MGH), and Brim of Massachusetts, Inc. (Brim).
