These cases were proceedings by certiorari to quash a levy of taxes by the respective County Courts of Chicot and Jefferson counties to pay the interest on certain railroad bonds which had been issued by them in pursuance of the act of the Legislature of July 23,1868, authorizing counties to subscribe stock in rail-roads and to issue bonds therefor. The sole question which we are called upon to decide is, whether the act of July 23, 1868, authorizing counties to subscribe stock in railroads, was duly and constitutionally passed.
The history of the law, as disclosed by the legislative journals, is as follows: The bill was introduced into the House of Representatives on July 17, 1868, and on July 20th it was read the first time. The rules were then suspended and the bill was read a second time. Several amendments were adopted, all of which were for the mere purpose of filling blanks, except one.
