[1] This is an appeal by the employer and insurer from the judgment of the Circuit Court of Cape Girardeau County affirming an award of compensation, in the sum of $3099.00, for the death of Wiley Tom Seabaugh, made by the Workmen's Compensation Commission to the widow and children of said deceased. The appeal went to the St. Louis Court of Appeals where, by a divided court, the judgment was affirmed.
