I. INTRODUCTION

Defendant James Robinson is charged by Superseding Indictment with possession with intent to distribute cocaine base (“crack”) (referred to as “crack cocaine”). Presently before the Court is defendant’s Motion to Dismiss Indictment (“Trombetta Motion”1), in which he argues that the government improperly destroyed the recording of the 911 call that led to his arrest.
