This was an indictment against Benjamin D. Ricker in two counts. The first count in the indictment, charges the defendant with the offence of procuring one John Staples to burn a barn described, which was burnt by the said Staples accordingly. The second count is against the defendant for burning the barn as principal. Staples had not been convicted or indicted, and was a witness for the prosecution. The jury were instructed, that if they were satisfied, that the barn was burnt by the act of John Staples, and Staples fired it by the procurement of the defendant, they might find the defendant guilty under the second count.
