Shalimar Development, Inc. v. Federal Deposit Insurance

Supreme Court of Virginia

1Opinion of the CourtJustice Koontz

In this appeal, we consider whether the trial court erred in granting a renewed motion to strike, setting aside the greater part of a $222,000 jury verdict for the plaintiff for defendant’s breach of a real estate brokerage contract. The dispositive issue is whether the trial court correctly determined that as a matter of law the plaintiff was not the procuring cause of a particular sale and, thus, that issue was improperly submitted to the jury.
