The dispositive issue on this appeal is whether, as a matter of the law of the case, appellant Thomas Lane was a joint tort-feasor hable in damages for the wrongful death of Eugene Scott.

The motion for judgment was filed by the decedent’s mother, administratrix of his estate, against Lane and Carl E.
