Carlton L. Moses ("Moses"), personal representative of the Estate of Bobby Gene Moses (the "decedent") appeals from the judgment of the Circuit Court of the City of Roanoke in favor of Southwestern Virginia Transit Management Company, Inc. and Karen R. Poindexter (collectively, "the defendants"). Moses contends the circuit court erred when it set aside a jury verdict in his favor and entered judgment for the defendants on the basis that the decedent was guilty of contributory negligence as a matter of law.
