This matter is before the Court on defendants’ motion pursuant to Rule 39 of the Federal Rules of Civil Procedure, 28 U.S.C.A., for-transfer of the action to the jury calendar from the court calendar.

Defendants own a multiple dwelling property which plaintiff contends is and has been subject to the Housing and Rent Act of 1947, as amended, 50 U.S.C.A.Appendix §§ 1881 et seq., during all times relevant to this action.
