On September 1, 1916, the respondents, Slocum, Wulff, Watland, Owen and Wells, being then the owners of certain mining claims situated in Stevens county, contracted to sell the same to one Van Horne. The purchase price of the property was $20,000, and was to he paid in installments running *633over a period of two years. Van Horne, shortly after the execution of the contract, assigned his interests therein to the Iroquois Mining Company, a corporation.
