Hopkins v. Pearce

Court of Appeals for the Fourth Circuit

Decided November 12, 1940No. 4669PublishedCited by 3 opinions

1Opinion of the Court

SOPER, Circuit Judge.

The only 'question in this case, which was removed by appellants, defendants below, to the federal court on the ground! of diversity of citizenship, is whether they were entitled to a ‘’directed verdict on account of negligence on the part of the-plaintiff contributing to dhe collision between two automobiles that gave rise to the suit. It is contended that the plaintiff committed two violations of relevant statutes of the State of Virginia, wherein the accident occurred, so that he was guilty of two acts of negligence which contributed to the unfortunate result.
