OPINION

In October 2003, plaintiff, James Hurlbert, was arrested for driving under the influence of alcohol (625 ILCS 5/11 — 501 (West 2004)). Thereafter, plaintiff filed a petition to rescind the statutory summary suspension of his driver’s license (625 ILCS 5/2 — 118.1(b) (West 2004)). The circuit court denied plaintiffs petition, finding that defendant, Andrew J. Charles, a police officer employed by the City of Urbana, Illinois, had probable cause to arrest plaintiff.…
