The defendant, Don Carlos Peak, was indicted in the criminal court of Cook County for the unlawful possession of narcotics. The defendant made a motion to suppress evidence, being marijuana taken from his person by the arresting officers, which he urged had been obtained in violation of his constitutional rights. A full hearing was held on the defendant’s motion to suppress and the trial judge, after hearing the evidence presented,, denied the defendant’s motion.
