OPINION

NETTESHEIM, Judge.

This case is before the court after argument on cross-motions for summary judgment. The issue, one of first impression before the Claims Court, is whether, under the Prompt Payment Act, the Government is obligated to pay a contractor interest on a late payment for merchandise which was ordered and accepted pursuant to an option created after the Act’s effect date, but which incorporated the terms and prices of a contract entered into before the effective date of the statute.
