On this day, the Court considered Plaintiffs “Motion for Leave to File Plaintiffs Second Amended Complaint” (“Motion”), ECF No. 41, and “Defendant’s Traditional and No-Evidence Motion for Summary Judgment” (“Motion for Summary Judgment”), ECF No. 62. For the reasons set forth herein, the Court GRANTS in part and DENIES in part the Motion. The *559Court DENIES the Motion for Summary Judgment as moot.
