OPINION

LATCHUM, Chief Judge.

William R. Watts (the “plaintiff”) is the owner of two United States patents that describe and claim a chair frame. He has filed a two-count complaint against the University of Delaware (the “University”) seeking injunctive relief and damages. 1 Count I alleges that the University has infringed both of the plaintiff’s patents. Count II sounds in unfair competition.
