In this patent infringement litigation, Gilbreth International Corporation (“Gilbreth”) the plaintiff, having been unsuccessful in reissue litigation before the United States Court of Customs and Patent Appeals, has filed a motion pursuant to Fed.R.Civ.P. 41(a) seeking a voluntarily dismissal with prejudice of its complaint against the defendants.
