KNIGHT, Circuit judge.
Plaintiff, a citizen and taxpayer of the City of Rapid City, has brought this original proceeding to enjoin and restrain the defendant city and its officers from carrying out the provisions of a contract executed on July 27, 1943, by said city, the United States, by the Secretary of the Interior, and the Rapid Valley Water Conservancy District, hereinafter referred to as the district, and to secure a declaratory judgment as to the validity and effect of said contract.
