Proceeding pursuant to CPLR article 78 to review a determination of the Police Commission of the Town of Stony Point, dated April 28,1982, which, after a hearing, sustained certain disciplinary charges against the petitioner and ordered his dismissal from the Town of Stony Point Police Department. Petition granted to the extent that the determination is annulled, on the law, without costs or disbursements, and the matter is remitted to the Police Commission of the Town of Stony Point for further proceedings in accordance herewith.
