Edward Newbrand died on the 25th day of March, 1938. He was a member of the police force of the city of Yonkers and at the time of his death his annual salary was $3,000. Local Law No. 1 of the City of Yonkers for the year 1931 provides that the “ board of trustees shall grant pensions out of said pension fund, in the following cases * * * 2.
