LATTIMORE, Judge.

Conviction for forgery; punishment, two years in the penitentiary.

Two questions confront us, one being the sufficiency of the indictment, and the other the sufficiency of the testimony. The trial court submitted to the jury in his charge only the first count in the indictment which charged, in substance, that George Simms did without lawful authority, and with intent to injure and defraud, wilfully and fraudulently make a certain false instrument in writing purporting to be the act of another, to-wit: R. C. Simms, which said false instrument is to the tenor following, — and…
