It appears from the complaint that Solomon B. Miller and Joseph Hatfield were each asserting conflicting rights in or title to a certain tract of land in Howard county, the land being at the time in the possession of third persons, who also asserted an interest therein. For the *464purpose of compromising their claims, and avoiding litigation, it is alleged that the plaintiff and defendant mutually-agreed with each other that each would make a conveyance of the land to a third person as trustee, for the benefit of the defendant, Hatfield, the latter agreeing to pay the plaintiff a certain sum of…
