¶1. Mark Shimkus, an inmate at Fox Lake Correctional Institution, appeals an order dismissing his petition for certiorari review of a prison disciplinary decision because the petition was not filed within forty-five days of his receipt of the decision as required by WlS. STAT. § 893.735 (1997-98). Shimkus contends in his appellate brief, as he did in his circuit court brief, that he put the certio-rari petition, along with a request for disbursement of the filing fee from his account and postage, in the institution mailbox on the thirty-sixth day from the date of his receipt of the decision.…
