AMENDED MEMORANDUM OPINION AND ORDER
RODRIGUEZ, District Judge.
This case is before this court on plaintiffs Hansen Savings Bank, SLA (HSBSLA), Hansen Bancorp, Inc. (Ban-corp), Elmer and Eileen Hansen’s (the Han-sens) request for declaratory and injunctive relief against the Federal Deposit Insurance Corporation (FDIC) and the Office of Thrift Supervision (OTS). For the reasons stated below, plaintiffs’ request for a preliminary injunction is granted.
