BEAM, Circuit Judge.

Barron Jerome Nelson (“Nelson”) was charged in a two-count indictment with conspiracy to possess with intent to distribute cocaine base in violation of 21 U.S.C. § 846, and possessing with intent to distribute approximately four ounces of cocaine base in violation of 21 U.S.C. § 841. Prior to trial, the-district court 1 denied Nelson’s motion to suppress evidence found pursuant to a search warrant, and also denied Nelson’s motion to dismiss the conspiracy count of the indictment.
