McMILLIAN, Circuit Judge.

Mark Prieskorn appeals from a final judgment entered in the District Court for the Northern District of Iowa upon a jury verdict finding him guilty of conspiracy to possess with intent to distribute and to distribute cocaine, a controlled substance, in violation of 21 U.S.C. §§ 841, 846 and 18 U.S.C. § 2(a). The district court sentenced appellant to five years imprisonment. For reversal appellant argues the district court erred in (1) denying his motion for judg*633ment of acquittal and (2) refusing to give the jury his theory of defense instruction.
