Defendant and Thomas Gr. McCrosky were indicted in the circuit court of DeKalb county for receiving a deposit of $60 as private bankers in the *483“Stewartsville Bank,” of which, they were owners and managers, knowing at the time it was so received that the bank was insolvent or in failing circumstances. The indictment is under section 1350, Revised Statutes, 1879, as amended by the act of 1887. At the April term, 1888, a severance was granted defendant.
