The indictment upon which Charles J. Meadowcroft and Frank R. Meadowcroft, the plaintiffs in error, were convicted, was based upon the first section of “An act for the protection of bank depositors,” approved June 4,1879. Said section is as follows:

“Be it enacted by the People of the State of Illinois, represented in the General Assembly, That if any banker or broker or person or persons doing a banking business, or any officer of any banking company or incorporated bank doing business in this State, shall receive from any person or persons, firm, company or corporation, or from any agent…
