DOBIE, Circuit Judge.

This is an appeal by the defendant (hereinafter called appellant), and a cross-appeal by the plaintiff (hereinafter called appellee), from a final judgment of the District Court for the Eastern District of Virginia in favor of the appellee and against the appellant in the sum of $3,500, plus interest and costs.
