This is an appeal from a decree of the District Court of the United States for the Northern District of California, sitting in ■admiralty. The libel alleges that the appellee was a passenger on board the steamer on á voyage from Sacramento to San Francisco, in June, 1851, and that, while navigating within the ebb and flow of the tide, a boiler flue was exploded through neg*473ligence, and the appellee grievously scalded by the steam and hot water. •
