Error to Macomb Circuit.

This was an appeal by the defendant in error, from an order of the probate court for the county of Macomb, upon an accounting of the plaintiff in error. In the circuit court the matter was heard before a jury, who returned a special verdict, upon which a final order in the nature of a judgment was entered. A bill of exceptions was settled, and the case is now before us upon writ of error, brought by the administrator. The course of the inquiry in the circuit court was regulated by a stipulation that the issue to be tried, “shall be the same as was tried in the said probate court, to wit:…
